GPLv2 is buggy as it allows TiVO-ization. GPLv3 fixes that bug, so it is more sensible choice. Kernel stays v2, but we have drivers that are dual BSD or v2+, so that they can be used for other projects. One day we might want to run GNU Hurd or something...
