Its not. A file bearing no copyright statement is copyright the author with
no license implied under the Berne convention (which the US eventually
ratified) and which the EU has long been signatories too. So either

a) They took code thats GPL'd
b) They took code thats unlicensed to them

Anyway so long as they fix it pronto
