Aside from licensing issues (and those can be avoided there are common licenses that fit both) there is a huge problem you ignore - the whole philosophy of many of the two kernel designs is very different. You'd never for example get a network driver for one working with the other. In fact it would be far easier and more productive if we wanted to take the hit for some poor unfortunates just to support NDIS3.
