Why not do something like;

static struct nmiaction hpwdt_nmiaction = {
.handler = hpwdt_pretimeout,
.name = "hpwdt",
};

...
if (priority)
hpwdt_nmiaction.flags = NMI_FLAG_FIRST;
...
