I tested again with 2.6.38 kernel: the system was stressed for several hours with various activities (compiling, copying data back and forth from two hard drives, encoding/decoding video streams, etc) but I was not able to reproduce the problem, so I guess it has been fixed. If you're interested here's the info I collected with 2.6.38:
