Thats not actually the case. The law in countries writes in additional implicit clauses you cannot avoid and also forbids clauses. Those clauses vary by country but you'd find in most of the world that a clause like
3. Not to be used by Women except for payment of a $500 additional tech support fee
would not be enforcable
