And what if you generate the fax data straight from the PostScript to produce a cleaner fax, so there never is a paper copy?
The safest loophole through the idiotic regulations is the excerpt printed on the cover of each of the PGP books:
A printed book or other printed material setting forth encryption source code is not itself subject to the EAR (see Sec. 734.3(b)(2)).
Bureau of Export Administration, Commerce Interim Rule of December 30, 1996
(This "interim" rule is still the current one. And no, this is not a misleading out-of-context quote.)
Marks on paper is most clearly "printed", but since the rule doesn't define it, you'd have to find a way to defend the claim for a pure fax.
The problem is that idiot bureaucrats are trying to draw a line where none exists, so there is no "obvious" correct answer. Here's the fuzzy line:
- Print out book, mail it, scan it there. Almost certainly safe. - Print out book, fax it. Interesting question. Court rulings on faxed documents might be relevant. - Print out book, fax a copy straight from computer. Even more interesting. - Don't print it, just fax it.
I'm pretty certain that what is done with the data at the far end is irrelevant. But could I suggest that people interested in exploring the bounds of legality also be aware that it's highly desirable that they not lose the test case? Conversely, someone who might not be able to afford "justice" in Mussolini's America might be seen as a juicy target precisely because the test case will go as the prosecution wants. -- -Colin
